When you are President of the United States and you leave the White House for the final time, the very act of taking classified or non-classified documents before you leave the White House is a Presidential act. If an ex-President has classified documents, he didn’t acquire them as an ex-President. A President can classify and declassify at will and doesn’t need to follow any protocol – he is the executive branch.
The Espionage Act cannot be used against presidents or former presidents as it is unconstitutional as it applies to them. Furthermore, there is no need for a search warrant just to reclaim documents for NARA. A subpoena needs to be enacted, not a search warrant. This is a grievous violation of President Trump's 4th Amendment rights and cannot be allowed to stand. What they were after was anything they could find related to Jan 6 as they currently have nothing.
