Private thought and speech is not against the law , but Sterling is to an extent a public figure and the public has the right to reject him and his thoughts , like they did Romney.

Didnât we just call to task the NSA for intruding into American citizenâs privacy in such an un-American way? Although the impact is similar to Mitt Romneyâs comments that were secretly taped, the difference is that Romney was giving a public speech. The making and release of this tape is so sleazy that just listening to it makes me feel like an accomplice to the crime. We didnât steal the cake but weâre all gorging ourselves on it.
This is not like Romney because Romney's speech was public and as such there was no expectation of privacy. In this case, the girl's lawyer was quick to state that Sterling asked her to record all conversations because he is senile, thus overcoming California's two party consent wire tapping law.
