I do not believe a way to avoid tax on realized gains but you may be able to deduct some expenses. If moving to a no State tax Stat is an option then that is most numerically meaningful. This year (2021) I will meet the standards for Trader Tax Status, and file as a Sole Proprietor. It won't change the tax but allows some expensing. An LLC with S-Corp election is a common approach but laws around pass-though corp may be changing. Qualification for Trader Tax Status is the first thing to consider. If you do not meet that grey standard then the topic comes to an end for you. I also focus on selling premium on 1256 products. Seems so easy...until I am wrong for too long.
Hey thanks for the info. I'm curious how you are taking TTS with a premium selling strategy. My conversations with various folks led me to believe that you needed to be opening and/or closing numerous trades a day, almost every day. Is that what you do?
@dcwriter, there are no firm rules but most experts state 700+ trades/year with less than 30 hold times. My premium selling has two models. One has hold times of 1-3 days, and the other model has hold times of about two weeks, maybe three weeks at the most. Each leg is a "transaction" so it adds up.
