Actually, it does not matter what the "fine print" says. If someone publishes on the web, it does not freely belong to the owner of the website. In fact, publishing to the web is a form of "publishing" and legally belongs to the original poster (who of course, has the burden of proof to show that S(HE) was the actual person. If someone publishes their song lyrics on here for example, they still belong to that person. They are not now "public domain" In the same way that if someone puts out the lyrics of their own or someone else's copyrighted song makes them belong to Baron now or anyone else, for that matter. For example (from univ. of CA website): <i>What does an author have to do to obtain copyright protection for his or her work?</i> Absolutely nothing! Under the present Copyright Act, copyright protection begins automatically upon creation of a work, and the work is "created" when it is fixed in a tangible medium for the first time. The work does not have to be registered with the U.S. Copyright Office, nor does it have to carry a copyright notice. Both are advisable, however. See Questions 7-9 below. <i>How can I put a work in the public domain?</i> Since the 1976 Copyright Act provides that copyright attaches automatically upon the creation of an original work that is fixed in a tangible medium of expression, copyright protection has been automatic. Consequently, if you want others to have free use of your work, you can either make it clear, preferably in the work itself, that you do not assert any copyright ownership and waive any copyright interest, or you can retain copyright ownership but grant a non-exclusive, royalty-free, fully-paid up license to another person to use, reproduce, modify, and prepare derivative works based upon the original work.
