Derek Chauvin jury reaches verdict in George Floyd case

  1. I said all of those matters are addressed in pre-trial so they were already done. Thank you for confirming what I said.

    And jury nullification means you cannot appeal just because you claim you got an unfair trial. You need an actual mistake of law or application of law to claim something on appeal to get a decision from the higher court to remand and order a retrial (I will give oyu a hint how often that happens).

    You don't overturn a jury decision in criminal cases unless you have an actual cause for appeal (incorrect decision of judge on objection, prosecution mistake). Not because you claim the jury is biased due to high profile case.

  2. This verdict will at least stop the insane rioting/looting that would of happened if he was found innocent of all charges. A vigorous appeal will ensue. We can thank Waters, Pelosi and Biden for helping with that.

  3. I have to admit I was not expecting all 3 counts guilty. because of that the minimum prison could be closer to 15-20 years...who knows what the judge will do.

  4. There is no cause for appeal just because Waters said something and Biden's comment was while jurors were sequestered.

    The only cause for appeal is for defense to claim the INTENT required under the higher murder charges were not proven. That is a question of law and something that defense can appeal.

    Sorry if you disagree with the verdict.

  6. You have to look up MINN law and see if sentences are concurrent and can be served consecutively.

    Mmmm, no. Each charge carries it's own punishment. He can get up to the maximum for EACH charge. And the judge can decide to have them run consecutively, or concurrently.

  9. From what I gather they can add up the prison sentences for each of hte 3 charges and give one sentence:

    If two or more sentences are consecutively executed at the same time and by the same court, the Commissioner of Corrections must aggregate the sentence durations into a single fixed sentence. The aggregate term of imprisonment must be served before the aggregate supervised release period.
