The DOJ never wants anything released but then they leak whatever works for them. Whether it is true or not does not matter. We saw all of this in action through the Russia scam, didn't we? They also got Trumps tax returns, medical records, Barron's computer games and Melania's underwear too. Because "national security." Not seeing many leaks from the Hunter investigation are we?

The DOJ has appealed the decision. IMO they had to appeal this judge's decision in order to firmly establish a legal principle. It involves more than one issue, even though people treat it as one and as a decision about whether there will be a court master. Nope it is probably more about what the court master can do or prevent rather than whether there will be one. My guess is that the Appeals court will uphold the right of the lower court to appoint a master as it is fairly common to do so when a complex case is at hand. On the hand, in regard to the issue of whether the prosecution should be allowed to see that material as part of developing its case while the court master is reviewing, probably the DOJ will win on that, although the court may not allow a grand jury to see it without the court master reviewing what they want to present. I am not sure on that either but Garland has a shot at it. What works against him is that Garland has already said that he is going to move any decision out until after the election so that might signal to the judge that they are not highly disadvantaged if they have to wait. Garland would have to counter-argue that something heavy and immediate is going on that requires pursuing it immediately. And it is also goofy because the court knows that they have already seen it anyway. Garland has to make argument and sound good on all of that. I have no idea whether he can or cannot and the appeals court is likely to remand a lot of things back to the lower court after it decides certain things, so that adds time. I have said only, that once the defense shows up, everything that Garland gets he will have to work for. And indeed that is so. There is a pantload of motions to come on this case, he will lose some and win some. The decision to raid was an ex parte process so basically all he had to do was decide that he wanted to do it and make assertions to a judge. The defense is not allowed to appear.
Reading the PDF of the DOJ filing makes it clear that they are completely opposing the appointment of the special master -- not about what the special master can or can not do.
