That's the thing I don't quite understand about the need for ETF "approval". What's stopping anyone from starting a company (or doing a reverse merger) called "Bitcoin asset management" and buying Bitcoin? Then if the share price goes way above net asset value, you just sell more shares, and use the proceeds to buy more Bitcoin. As far as I can tell, the only difference between a "true" ETF and my hypothetical company "Bitcoin Asset Management" is that an ETF has the create/redeem process, whereas "Bitcoin Asset Management" just sells stock in a secondary, like any other company. .
