I'm no fan of tobacco and the whole denial thing presaged what we're seeing with the anti-science moves today. But I'm not sure anyone really wants that to happen. Once you do it with tobacco, why stop there. Next up would be anyone involved in asbestos, I mean they made kids pajamas out of the stuff for peet's sake! And lead paint, for sure. And we definitely need to go after coal mining and electrical generation; the particulates from coal plants cause over 10,000 premature deaths a year. You can see where this would lead?

That won't be able to be proven in court as there ARE people who are subject to the same "psychological manipulation" and never smoked a cigarette for a second in their whole enter life. And there are plenty who were hooked on cigarettes for many times and have quit successfully and never picked up a cigarette ever again and yet they are also exposed to the same "psychological manipulation". So it still comes down to individual choice.

What they DO need to go to jail for however is for fraud, misrepresentation and deceptive advertising. On one hand, they advertise low tar, low nicotine as an advertisement for better impact on health but they were adding chemical additives in secret without disclosure knowing that they would have negative impact on their customers' health just for the purpose of retaining customer base through not psychological manipulation but physical manipulation.
