This will bring up a great question. Can a lawful order be issued by an unlawful commander in Chief. Will a court allow this officer to test that issue? If a court does, then the court will have to allow discovery. It could get very interesting. Obama signed an order saying that the evidence will not be turned over. (from what I read) So now you will face off between a judicial order for inspection of records vs an executive order. Will this be tried in a military court. This could get interesting. If the court allows discovery you will see this case get dropped faster than a hot potato. And that will be 2 strikes against the legitimacy of the commander in Chief. And it will send a bad message through the chain of command.
