Good thing his best bud, Mueller the Clown, is looking out for him. Hope that works, otherwise he is going to be doing some splainin to the current Justice Department- in court. http://thehill.com/policy/national-...ersations-contained-classified?rnd=1499645596
Are we going to see a perp walk? From article: "More than half of the memos former FBI chief James Comey wrote as personal recollections of his conversations with President Trump about the Russia investigation have been determined to contain classified information, according to interviews with officials familiar with the documents."
More idiocy from Cons Comey was an OCA, he had the authority to determine classification which means he could say it was unclassified, if someone at a later stage determines that the info may be classified, that doesn't make Comey's determination invalid or illegal. http://itlaw.wikia.com/wiki/Original_Classification_Authority
Being an OCA is not a get out of jail free card. An OCA does not have full discretion. There are written guidelines.
Great, then name ONE OCA who has went to prison or even prosecuted for their own memos - hell, let's expand that. Name ANY OCA who has EVER been prosecuted, EVER for anything classification related.
Irrelevant. I don't know if one has or hasn't. If it hasn't happened, it doesn't mean that there can't be the first one.
It hasn't happened because it CANNOT happen, if an authority determines something to be unclassified and a later authority determines otherwise, the first act doesn't become illegal as the entire system of classification is based on a series of executive orders and has no specification in law. Plus, there is no central classification agency either, every department is free to determine it's classification and has it classification disputed by another agency, doesn't make the actions of the original department illegal. No OCA can ever be legally accused, let alone prosecuted for mishandling their own information, it's impossible.
Okay. So say a person is an OCA. That OCA has the plans for a to-be-built nuclear submarine. The plans haven't been classified. The OCA releases the plans online. That OCA is free from prosecution? That is not how the law works.
