    jim and todd and others: thank you for your comments. i am very sorry that people are losing money but jim as you have stated so eloquently many times, as pros we owe it to our readers to call 'em as we see 'em. my market calls are in the archive like everybody elses. additionally, i guess i don't feel as if asking gary about gaps is "gloating" or "rubbing salt" in others wounds. i'm sorry that i have been short but perhaps it is a strategy we might help our readers learn how to adopt with a portion of their portfolios. i assume i'm fired from this point on? if so, i wish you all well and thank you.

    It is one thing to read this stuff (ts.com, hoenig, lbr, teresa lo, etc etc ad naseum) as an attempt at eductation and expanding one's horizons. But who calls himself a trader that takes a trade based on a "call" ?

    Aside from God coming down and giving me a tip, I couldn't give a shit what these people say with their endless "analysis."

    I use to listen to you and Hoenig on the Radio in LA. You guys gave great Tips and did even better Radio together. wHat Happend to the show ? is this why it is no Longer oN the AiR ? Please keep up the great posts here.

    I just paid my California Bar dues today, so perhaps I should put my rusty litigation skills to work.

    I too have had my business reputation tarnished on this very thread. Someone using an alias mentioned earlier that a particular article was a "jem". Now it clearly was not authored by me jem so do I have an action for business defamation?

    (I believe the proper word was "gem").

  9. wow, lotta emotion on this thread. I have very mixed feelings about Cramer. I have learned an awful lot from reading him over the years, but his macro stock picks tend to be average at best. Clearly not how he made money in the day. As annoying a self promoter as he is, I have to admire his ability to basically create a new way of communicating for traders. Where would we be without TheStreet.com?

    And as annoying as he is on TV, I love Kudlow&Cramer. I think it is handsdown the best show on cable.

    As for this lawsuit, I predict it is a loser or maybe settles for nothing. Hoenig is probably a public figure. As such, he has to prove actual malice, meaning he has to prove Cramer said something false, knew it was false and intended to hurt hoenig. If Hoenig actually said something about KMart, even in jest, he loses, as truth is an absolute defense. Otherwise, Cramer can plausibly claim he made an honest mistake, or that he didn't mean it literally but rather just used it to illustrate his opinion of Hoenig. Judges tend to disfavor this type of case, and view it as a pissing match between media figures rather than a serious issue.

  10. if cramer had never started picking stocks his guru status might have been saved. when you are a loudmouth and basher you have to back it up. if you put your own record out there and it is as bad or worse that most you had better shut up.
    that said the lawsuit is bs.
