  1. Well that is not legally binding, just their opinion really on whether Fed should. It is like if the GOP said fed should not raise taxes, it is just a political position not a legal one.

    Oh, I agree. But it doesn't help your case when the opposing attorney points out the various montage video that shows you specifically stating something cannot be done, that you're now trying to force through.

    or now that OSHA itself has ceased its attempt.

  3. It just makes them look bad in court of public opinion but not in a real court.

    "Your honor, under OSHA blah blah blah we are given the authority as per statute/regulation blah blah blah..."
    Then the video montage of opinions goes away as those are not binding.

    It is the same as when trump complained the election would be fraudulent in 2016 and then he won. Democrats could not present as evidence in a challenge that trump claimed the election was going to be fraudulent.

    More fodder for 2024 agaisnt them though

  4. I am sure they responded to the 6th Circuit opinion so it makes sense to pause if an appellate court said you are over reaching.

    I am also sure OSHA's internal attorneys are happy because they were being forced to swallow this stinky dick.

    As someone who did legal work for some government agencies in my prior life, when a political appointee shoved their contrary policy decision down our throats and we had to make it stick legally or legally justify it, I felt filthy haha. Here OSHA lawyers got saved.

  6. This is true. It is like when Obama said he did not have the power to enact DACA by executive order. Then he does it.

    I can agree that there is a lot of general political verbiage that does not carry any legal weight but do not necessarily agree that it is never relevant legally. The courts are or should be properly vigilant for presidents trying to use executive orders and/or emergency powers in matters where they are really saying "yeh, I know congress is sitting over there in session and I know they have the proper jurisdiction here but I don't know if I can get the votes."

    Sometimes, if not often, both Biden and Obama make/made comments that are evidence of that.

    Joe is pretty good at remembering.

    He has gone to lots of places and is the only one who remembers what he says happened.

    Being shot down in AFG, being in jail with Nelson Madela. Just last month he gave a speech and talked about when he went up to New York or some place to speak to the people at that synagogue where there was a shooting. Now, the rabbi says neither he nor anyone else ever saw him there.

    Things like that. Ya. When it comes to remembering Joe is the best.
