Not sure what you mean, 5000 feet below the surface of the ocean or 5000 feet below the sea bottom? Oil floats so if it were leaking to the sea floor then there would be a slick on the surface - that is a given. If it is "leaking" deep in the well bore but being contained by the cement plug at the top then I don't consider that leaking at all.
