Sure, it probably has legs, but the majority of employers will simply mandate the vaccine. Employees will rail against it publicly but get the vaxx out of abject laziness. Because it makes sense. If an employee is not engaging in activities the rule applie to then the rule doesn’t apply. The broader rule will work because the testing is lawful. Remember when the aca was defended in court as a mandate under the tax code - that was a mandate by coercion. This broader testing rule is the same legal principle. You’ll see.
