Biden was right: MAGA ideology is fascism

  3. Courts interpret text within context. Or are required to anyway. The 9/11 era law regarding soldiers and their student debt was written within the context of well....errr..... 9/11 and soldiers.

    In addition to the interpretation of the constitution and statutory laws, the court, especially the lower court is free to make a decision on the facts and to decide whether an emergency truly exists whereby it so immediate that the President must act without Congress. The Supreme Court- the loons aside- is often reluctant to let a president usurp legislative power while Congress is either in session or reasonably available to take action or hear proposed amendments that could clarify rather than churn it through the courts.

    But as we know, this would be heard in a DC court so one starts with what the dems want and then the courts fall in line if they can. Sometimes it becomes so ridiculous that they cannot.

    Biden is running a con game. He is going around the country arguing for political purposes that he has conquered covid and the economy has recovered and that there is a job for anyone who wants one. Then out of the other corner of his mouth he argues that he has the power to declare covid an emergency permanently impacting students ability to pay their loans. He is well into weasel territory with that argument.

    This is actually pretty cogent. Tip my hat.

    Probably still not good enough when the government will argue something to the effect of it is within the national interest for students to be able to afford homes and care for children and the current conditions deteriorated so much due to the pandemic relief became necessary.
