I have not read the entire HEROES act so I will refrain from giving any detailed opinion but all I said is I could see the SC saying Biden did not have the authority through the DoE to simply wipe out a broad sepctrum of student loans when the act was for exclusions for specific candidates who met certain criteria. If I understand correctly Biden waived debt for anyone making under a certain income level. If that was the only requirement then it is pretty arbitrary because then it is not within the HEROES act intent. I may have posted before itt that they should've gone w/the Higher Ed Act for more solid footing but were opening themselves to con lawsuits but dems chose not to because that was their expectation (not really wanting to forgive the loans and add to the debt).
There are a lot of buried issues in this but the fact that people are challenging it simply becuasw Biden proposed it or wealthier people are asking why they cannot get $10,000 forgiveness leads me to believe this has nothing to do with any desire to uphold the constitution but simply to play politics with an issue.... since that is the case the decision will also be based on politics and not law.
