  5. There's a lot of constitutionality questions about Biden's ability to do this. If it goes to the Supreme Court he's very likely to lose. Some judges have rejected plaintiffs, not based on Biden's constitutional authority, but rather on the idea that the plaintiffs don't have the standing to challenge him. I think it's obvious that we need a better mechanism to challenge executive order overreach.

    A partisan court filled w/partisan hypocrites having a change of mind curbing the executive power does not mean the president doesn't have the power to do something, it just means they opt to set precedent to take that power away. For reference see "settled law" Roe v. Wade

  7. Well, the court is often partisan and hypocritical. I think this is very different than Roe v. Wade. In Roe v. Wade, they were arguing that the settled law/ruling itself was unconstitutional. In that situation there is obvious precedent, the original ruling. From my understanding, they aren't arguing the actual constitutionality of the Heroes Act or any other law per say. They are arguing that there's no act that actually gives Biden the authority to cancel student debt and he is therefore violating the Constitution. Biden is pointing to other debt cancelations as precedent. However, I'm not sure how many of those were challenged and therefore could actually be considered legal precedent. I'm also not sure if the same arguments applied within the context of the laws written.

    Yes, curious how the Heroes Act passes unanimously in congress and never sees a court challenge because "respect the troops" and will likely be found unconstitutional by hypocritical SCOTUS now. Wouldn't shock me if the assholes only find the "national emergency" clause unconstitutional, the precise clause that gives Biden the power.

    Like I already said though, I doubt the admin fights it as they had to have their arm twisted to even jump on board.
