  1. How would you sue this company?

Let's put together the steps to start the process.

**SMH** Ever heard of Class Action Lawsuit??? It was for this kind of bullshit that it was created. I suggest you reach out to others who have been in similar situations and hire a qualified lawyer.

  3. Sorry to hear about your experience with this bucket shop operation. I've warned against them repeatedly on this site. I like to refer to them as Scampex.

My impression is they'll pay out so called influencers on Twitter or YouTube to make it seem legitimate and it would be very bad press to not do so. This also helps draw fresh meat in. Then they'll easily deny the common man without any reach their money.

  4. No, I wasn't. I sent them four videos. The first two showed my trades, but they didn't accept those and asked for my strategy. So, I sent the next two with the strategy in detail, but they closed my account. I guess they figured they couldn't make money off of me

They know what demo they are targeting. Class-action takes years. This "Darrell Martin Apex Trader Funding" loser knows how far he can push it.

I would absolutely travel to whatever s-hole jurisdiction this scammer operates in and pay what it takes to file suit. The major expense will be service. It will compel him to appear.

The point of the class action ain't just to get your money back. It's to make them go out of business. At the very minimum, you wanna leave a legal precedence to prevent potential asswipes like Apex who think they can get away with this kind of behavior.

Anyway, not taking any legal action against Apex would be, frankly, stupid IMO. You're pretty much giving these bastards a green light to rip you off.

Lawyers don't work for free. Class action requires deep pocket for the one been sued. I suspect there is no money in a small prop firm and it is very hard to get a law firm interested in this case unless OP is willing to pay the legal fees out of pocket.

That is why most Ponzi schemes are handled by the government instead of private citizens that were harmed, unless the case has enough assets to pay the lawyers richly, like Madoff.

My advice is file complains with the relevant agencies and move on to focus on trading again because it sounds like OP is there and really do not need a prop firm to make money trading.

I would file a lawsuit asap.

this doesn’t cost a lot of money. Maybe a few thousand (4 hours of legal work). The real cost is in due dilligence but that’s very far down the road and apex will want to settle before they spend that kind of money. a lawyer will know how to handle the negotiations up to that point and in all likelihood you get your money well before you spend a lot on a lawyer.

a lawsuit is a problem for a company as it prevents them from raising capital from any institutional investor (which it looks like apex might need to do based on an article I read).

edit: in civil litigation matters, lawyers are really brokers using the law as the rules for their engagement. If a deal can’t be reached then it goes to trial, no one wants that. So there’s some game theory involved involved.

  9. Several references say Austin, TX. If he is still in Austin, process is dirt cheap and quick. Unless we are talking a "Kind word and a ..." type of service. Of course we are.

Darrell Martin, you'll want to pay your obligations. Now. "Poopy" is a nickname based upon a natural body function that occurs when the person visited by Poopy realizes it is not a social call.
