But in a 2-1 decision, the judges on the 9th Circuit Court of Appeals, agreed with the government that Judge Simon’s initial ruling was too broad. “Given the order’s breadth and lack of clarity, particularly in its non-exclusive indicia of who qualifies as “Journalists” and “Legal Observers,” appellants have also demonstrated that, in the absence of a stay, the order will cause irreparable harm to law enforcement efforts and personnel," two of the three judges wrote. "This means that journalists could be subjected to the same physical force as that of the individuals participating." Attorney William Barr said in a statement that he thought the decision was "an important step." "Last night, the U.S. Court of Appeals for Ninth Circuit entered an order temporarily blocking an injunction entered by a federal district court in Portland that imposed extensive but vaguely defined constraints on federal law enforcement personnel striving to protect the federal courthouse and surrounding areas in Portland from destruction," Barr said. “In practical effect, the district court’s order prevented the federal government from effectively addressing violent mobs through the general crowd-control measures that are required, and it unacceptably increased the risk of serious injury to federal law enforcement officers. The Ninth Circuit’s decision is an important step that will allow federal officers to continue carrying out their important security responsibilities without being subject to untenable conditions.” Federal agents from the Department of Homeland Security and US Marshals have been deployed to the area around the federal courthouse in Portland for the majority of the summer in response to to unrest in the aftermath of the George Floyd's killing. The Department of Homeland Security has come under heavy scrutiny for the deployment of federal agents there and journalists have extensively documented their role.

I posted information which provided videos of the incidents and provided facts regarding the law (for instance he was charged in Wisconsin not in Illinois as others alleged). As I stated earlier, there is a strong case to be made for self-defense in all three shootings IMO. However the entire case is complex -- with issues with him being a minor as well as other issues -- where was the gun obtained & was it carried across the state border - and under law does this have any impact. To cite a similar case in North Carolina, we had a unsupervised minor drive & carry a pistol across state lines from Virginia to North Carolina so he could go shoot at his grandparents mountain cabin while staying there over-night. Legally he is not allowed to own or carry the pistol across state lines. However when someone broke into the cabin where he was staying - his self-defense claim was found to be perfectly valid despite illegally being in possession of the pistol as a minor. In regards to the shootings in Kenosha the case is complex enough that I will let the courts sort it out. I expect the decisions of the court will drive precedent for future similar cases in the state (and possibly in other states with similar laws).
Appreciate the response. Just wanted to add that I agree; it seems to be a difficult case. But I haven't seen the video where he shot the guy he had words with earlier, in the head ... which led to others chasing him down. You nor I (well ... 'I') couldn't shoot a cop simply because they were chasing me after I shot someone in the head, even if I heard them yelled "KICK HIS ASS" while they were chasing me. Even so, there is a huge difference between bringing a gun with the intent to 'go shooting at Grandma's cabin,' versus bringing an AR to heated protests, 20 miles away. I suspect the question of self-defense is apart from the carry violations.
