If you look at the senate bill from 2013, there is plenty of money for border security and e verify and a number of other things. Under the equal protection clause the right to due process applies to anyone on us land. So I don’t know what you mean by that. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
So you're making my point? You actually think it is unconstitutional to distinguish between citizens and illegal immigrants? Let me give you a quick primer on constitutional law. What constitutes "due process" varies with the circumstances. For an illegal seized in the country, they are entitled to a hearing before at least an immigration judge. If detained at or near the border, they are not entitled to anything. Similarly equal protection varies with the circumstance. Otherwise any distinction made in law would be unconstitutional, clearly an absurd result even for something as poorly drafted as the 14th Amendment. Immigration status is not a protected category like race and therefore legal distinctions or policies only need meet a very low standard of rationality.
You guys really will argue anything. Discrimination is a legal term and, yes, under the constitution while due process is afforded to foreigners on US lands, the justice system can certainly, and should, discriminate based on residency status. I don’t know why you are posing this as something democrats oppose. I’m sure there are some advocacy groups and fringe types that argue differently but by and large this is understood. If you look at Obama’s deportation record, his administration deported at record numbers totally within this framework.
