NYC teen spends 3 years in solitary with NO TRIAL after being falsely accused of stealing backpack This is among the most egregious violations of Constitutional rights that I have read about in a long time. from Raw Story: On May 15, 2010, Kalief Browder was returning home from a party in the Bronx with a friend. He was stopped by police, who were working on a tip that he had robbed someone earlier that night. In the backseat of the police car, the man who provided that tip pointed at Browder and said he had stolen something from him. “I didn’t do it,” Browder responded. “I didn’t steal anything. Check my pockets.” The police went back to the car to consult with the man in the backseat, who then changed his story, and said that the robbery had occurred a few weeks earlier. Browder accompanied the police to the station, thinking, “I’m just going to be here for a couple hours. We’ll clear up this misunderstanding.” It would be three years before the “misunderstanding” was cleared up. He was sent to Rikers Island, the jail complex where individuals from New York City wait while their case moves through the court system. Because Browder was on probation for a prior case, his bail was set prohibitively high — $3,000 — and his family was unable to pay it. Like many, Browder was being held in one of the most appalling, abusive juvenile facilities in the country in order to force him to plead guilty to the charges against him. Jennifer Gonnerman, who wrote about Browder’s plight in The New Yorker, said that his trial was then indefinitely delayed. On June 23, 2011, prosecutors requested a one-day delay, which turned into three months, because on August 24, 2011, they requested another day, which also turned into another three months. On November 4, 2011, prosecutors requested another two weeks. “Once they asked for a week or two weeks, it would turn into a matter of scheduling,” she said. “Everybody looks at their calendars, and maybe the prosecutor can’t do it, or maybe the judge can’t do it, or maybe the defense attorney can’t. And it became a sort of logistics game at every court date. But, you know, one or two weeks turning into six weeks, you know, for somebody like Kalief, that’s six more weeks that he’s got to wait.” Gonnerman explained that this is because of what’s called “the ready rule,” in which prosecutors can say, “we’re not ready, but we can be ready in a week.” “So that’s one week charged against them,” she continued. “But the court — the next court date is set one month, two months, three months away. So that only counts as one week against the six-month deadline that we have in New York. So, even though he was held for three years, it’s not like there’s three — the three years count against him.” “So time is moving in two separate ways.” The charges against him were eventually dismissed — three years later — after the credibility of the witness became suspect. read the rest The 6th Amendment to the Constitution guarantees Americans the right to a speedy trial: In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence. The Browder family is now suing the state of New York for violating their son’s Constitutional rights. Honestly, the judge or judges who allowed this to happen should be disbarred as well. Normally, in cases like this - black/minorities against NYC law enforcement, one of Sharpton's pals, Sanford Rubenstein, is right there, by the victim's side, ready to extract his 45% of whatever he can squeeze from the city, which is more than willing to pay. The kid was ALREADY ON PROBATION FOR A PRIOR CASE. The 3 years he was in prison probably saved law abiding folks from countless thefts, robberies, and knock out games. P.S.- in typical liberal media fashion, the picture is of a MUCH younger Browder. Not the almost 17 year old who had multiple run ins with the law.
You're missing the point, CL. If he's not going to be tried, then he should be released. No matter who it is, they deserve a fair trial - not to be held indefinitely with no way to resolve the issue. I'm not arguing that the kid is innocent or guilty, just that he did not get his constitutional rights.
