In few places has the effect been felt more powerfully than in the sprawling 9th Circuit, which covers California and eight other states. Because of Trump’s success in filling vacancies, the San Francisco-based circuit, long dominated by Democratic appointees, has suddenly shifted to the right, with an even more pronounced tilt expected in the years ahead. Trump has now named 10 judges to the 9th Circuit — more than one-third of its active judges — compared with seven appointed by President Obama over eight years. “Trump has effectively flipped the circuit,” said 9th Circuit Judge Milan D. Smith Jr., an appointee of President George W. Bush. ... Democratic appointees still make up the majority of active judges — 16 to 13. But the court also has judges on “senior status” who continue to sit on panels that decide cases. Senior status rank gives judges more flexibility but allows them to continue to work, even full time. Of the senior judges who will be deciding cases on “merits” panels — reading briefs and issuing rulings — 10 are Republicans and only three are Democratic appointees, Smith said. “You will see a sea change in the 9th Circuit on day-to-day decisions,” Smith predicted. The biggest change will come in controversial cases that test the constitutionality of laws and the legal ability of presidents to establish contentious new rules. The 9th Circuit is weighing challenges to Trump on a wide array of issues, from immigration to reproductive rights, and the rightward tilt is likely to make it easier for the president to prevail. Only two of the 9th Circuit appointees have prior judicial experience — Bridget S. Bade and Danielle Hunsaker. They also are the only women among the court’s new judges. Three are Asian Americans — one an openly gay man who has two children with his husband. The other five are white men. Several went to the nation’s top universities.

Monday morning the conservative-majority court agreed to hear Fulton v. Philadelphia, which is being litigated by the far right wing Becket Fund for Religious Liberty. Catholic Social Services is claiming it has a First Amendment right to discriminate against same-sex couples and LGBTQ people, – including refusing to allow them to adopt or foster children – while still accepting taxpayer funds. The City of Philadelphia stopped using Catholic Social Services because its policies violated the rights of LGBTQ people. The agency “argued that its right to free exercise of religion and free speech entitled it to reject qualified same-sex couples because they were same-sex couples, rather than for any reason related to their qualifications to care for children,” the ACLU wrote in 2018. The Third Circuit Court of Appeals had decided in favor of Philadelphia, ruling that the city “was neutrally enforcing a nondiscrimination policy that applies to everyone. The city hadn’t targeted the nonprofit group based on hostility to its religious beliefs, the U.S. Court of Appeals for the Third Circuit said,” according to Bloomberg Law.
Are you attempting to argue people should not be allowed to follow their religion? So freedom only applies when you think it should apply? This is a tough case where at an intersection of individual rights, religous rights, freedom and govt funding and societal good collide. One other point... a lefty would bring up as if it were legit in other scearios... shouldn't LGBTQ justices should recuse themselves. If they don't recuse then the decision won't be legitimate. finally, I don't think you really know where Kavanaugh or the the conservative judges will fall. But I think we have a better idea how the liberals will decide.
They can follow their religion all they want , why do they take money from gay taxpayers and still want to make discriminating against them legal. and what happened to separation of state from church ? as for Kavanah . . . . . .
what do you think separation and Church and State means and where did it come from. historically it meant that the federal govt was to not specify a particular religion as the state religion. it wasn't until a liberal court in the 1950s that the court started dismantling the ties between govt and religion. We are seeing a push back against some of those ideas. is your question really any different than govt taking money from those of us who think abortion kills human life and giving it to abortion clinics? The govt does a lot of things some groups don't like. Should the govt be in the business of setting aside money for minority contractors? Should race be a factor when hiring or letting people into schools? Why do schools take tax money from me and then give it away to other kids but my kids don't get the free money? Next year I will have 2 kids in college. That is a boatload of after tax dollars for us. Yet others go for free on our tax dollars. Is that fair? Isn't that real discrimination? Everyday almost everybody faces discrimination from whether you are good looking enough or smart enough or safe enough. Your question properly framed is whether that is legal discrimination or not.
