I'm a bit conflicted on this. On one hand, I wouldn't trust this administration to act in good faith, so I can see them pulling judges who hear these cases, making insurmountable backlogs, or them changing the definitions of what constitutes an asylum seeker. I have no illusions that Mexico will be as welcoming either, which goes against the spirit of America welcoming refugees. On the other hand, it would weed out future asylum seeking abusers who are riding the wave much like it happened in Europe. It will do nothing to stop illegal immigration mind you, but would clamp down on asylum fraud if there even is such a thing. It would also disincentivize any overly lefty admin from issuing these as free candy, knowing full well it would cause chaos with our southern neighbor. I don't think it should stop all refugees coming in from the southern border either....after all it's not the same thing for a South American to be stuck in Mexico as is for a Sub-Saharan African to be stuck in Mexico. Even if there is such a thing? Get real. Most of it is fraud. The majority of asylum seekers now are from central or south america and they know they are not eligible for asylum before they even leave home. Under international law, you must claim asylum in the closest country where you are not being persecuted or in imminent danger from the government or an organized group. For almost all of them- with some minor exceptions- that country is Mexico. Once you pass through Mexico because you think life is better in the U.S. than Mexico, you are now an economic migrant, not an asylum seeker. Their asylum claim becomes a fraud because they know they are not eligible from the get-go but they know that under American law/current policy, they will nevertheless be released into the community to disappear. Since the vast majority do not show for their hearing, their claim or argument doesnt matter anyway at that point. They just make the claim to gain access to the country. Mexicans in direct danger of being killed by their government or for cooperating with law enforcement and are targeted by a cartel have a possible claim for asylum in the U.S. because the U.S is their "closest country" under international law. Not so for central and south americans. Most of the mexican claims will not hold up either because they also just use asylum claim to get into the country, but at least they are not ineligible from the get-go as the others are. If you are coming through mexico, that is a disqualifier right there if you did not claim asylum in Mexico. Probably some exceptions but that is true for the masses arriving.
