Trump admin still sending "trial" census out including citizenship question to sow confusion

    The Trump administration is still finding ways to undercount minority communities in 2020 Census
    A quarter of a million people are being asked the citizenship question on test Census survey.

    And even though it no longer plans to include the citizenship question on the actual 2020 Census, the Trump administration is still in the process of sending out a test-version of the survey that includes the question to nearly a quarter of a million households throughout the country.

    Sending out the question, even during a test run, could confuse marginalized communities and prompt people not to respond when the actual survey is sent out next April, civil rights groups warn.

    Households with noncitizen members might question the confidentiality of their responses and choose not to respond, fearing possible government misuse of the data. The Census Bureau itself calculated that the inclusion of the citizenship question during the actual survey would cause an undercount of an estimated 9 million people.

    “That is a lingering concern but it’s especially a concern for us because it’s a concern for people responding to the questionnaire,” said Bradford Berry, general counsel at the NAACP.

    “There is a fear that the government will not use this information properly and that has led to the concerns of so many organizations to oppose the inclusion of the citizenship question.”

    The Census Bureau began sending out nearly a half-million test surveys to households throughout the country shortly before the Supreme Court decision was made. The bureau included the citizenship question on half of the test surveys in an effort to better measure the question’s impact on responses, according to Terri Ann Lowenthal, a Census expert consulting at the Leadership Conference on Civil and Human Rights.

    Lowenthal told ThinkProgress that sending out a test survey of this magnitude this close to the rollout of the actual survey is “unprecedented.”

    “There is no question that the current test will cause a great deal of confusion,” Lowenthal said. “The Census Bureau usually doesn’t risk the type of confusion this type of test would trigger even under normal circumstances.”

    The Constitution mandates that a survey of all people living in the United States be conducted every 10 years. That data is used to draw up congressional and legislative districts and to determine how billions of dollars in federal funds are spent.
     
  2. Bill Barr still slugging away, even though the odds are probably against him a bit.

    Barr knows and Trump knows that the botched construction and presentation of the legal arguments on this case were another "Jeff Sessions Special."

    Not sure you can unscramble the egg at this point but Barr will at least oversee as good a mop-up attempt as possible. The court did not like "stupid" so at least he will not do "stupid" and maybe that will count for something. We shall see.

  4. If you are replying to me, then the answer is "yes."

    The original filing in the case were all weak bullshit- no senior leadership oversight or legal expertise applied. The doj knew that there was also sorts of Wilber Ross comments coming back to bite them but did not present a full range of arguments to overcome the deficiencies. The court said as much by remanding it. Basically saying, "you might have a case here if you had done some fucking work."

    Yes. I blame that on the sleepy, stupid Jeff Sessions mentality that pervaded. Bill Barr will not allow that and he is not stupid. As I said, it might be too late to unscramble the egg, but at least he wants to put some duct tape and bondo on it as best he can.

    By the time Barr came along the case was already up through a couple levels of the courts, and Barr was stuck with the fact arguments that were already part of the record and on appeal.

  5. The Census Bureau themsevles were against adding the question in (under the Dept. of Commerce) and Secy of Commerce went soft on the issue deferring to DoJ.

    But you have seen this time and time again from Trump Administration, act first, think second. No one could have predicted a legal challenge and a shitty one was hastily put together. To me Commerce Department, who has their own staff of lawyers, punted the ball as well to avoid touching that turd.
     
  6. The Census Bureau is part of the bureaucracy. What they want is a consideration but not controlling. And yes, there was a lot of deferring to the doj, which has lefty swampsters on one hand and was being led by an idiot at the top who would also defer to them. As discussed. My point precisely.
     
  7. Uh the DOJ went ahead with the request to add citizenship, they did not object to it, the Commerce Department did. Don't rewrite the history and blame lefties. Career staff members from Obama did not fuck this up. The Trump Administration did because of the act first, think second mentality on most of their actions.

    FACT: Ross requested Commerce Department staff to get a citizenship question on the census months before the Justice Department became involved. The question, Ross says, was "previously raised" early in the administration by other "senior" Trump officials.

    My point remains.

    The case was weakly managed and constructed and lacked leadership. The doj put requests in to the filing as instructed but made weak arguments around it. And, yes, the Commerce Department klutzed around with Wilber making unhelpful comments and infighting between bureaucrats.

    As I have said. No one was in charge. Bill Barr would have worked with the President to determine what he wanted that was legally viable and then brought leadership and legal intelligence to the effort, duh, which would also have included banging some heads over in the Commerce and Census bureaucracies as needed.

    No leadership. No legal robust-ness. Jeff Sessions flaccid. Barr would not have allowed and would have brought a higher order to the whole clown show.

    And, I will say again, even though it is repetitive, even the Court said that they will remand it rather than dismiss or over-rule to give the doj another chance to put a fucking credible case together because their might be one there if they had done their job.

    Alright, enough.

    Your question was in regard to whether I am blaming much of this on the previous guy, ie. Sessions, and my answer is in the affirmative.

    I implied that I would accept the outcome of the court and move on within the decision of the court.

    The court has remanded it back to the lower court and stated that it is open to further argument and submission of briefs.

    I accept that completely. Not a problem.

    Similarly, you must accept the fact that Barr is working within the dictates of the Court decision by presenting additional arguments before the lower court. As authorized by the Supreme Court.
