hello Transatlantic, Why is VinnyEmini being sued? I thought he was a profitable day trader. He traded everyday for 90 days on youtube making money, right?
Did you actually read the ruling from the Appeals Court? John Matthew Cowart / Day Trader Paradise is being sued for fraud, amongst other things. What part of that don't you understand?
"[Mr. Marchi] was engaging in illegal trading conduct, that he was improperly giving investment advice, was an abuser of children and was a racist".
The bottom line is that DTP's appeal for dismissal was denied, and he (Cowart) must pay the legal fees EGI incurred.
Unfortunately the trading & investing space breeds a lot of unsavory characters. A valuable lesson of caveat emptor to the victims involved.
However there is one advantage of this suit going forward: the next phase is the discovery phase and at that time Vinny must turn over all of his financial records, including profits from trading versus profits from membership. At that time day trading paradise we'll be able to view for the first time the actual profitability of vinny's trading. It was such a discovery phase and the lawsuit of similar kind which revealed that Rockwell trading was entirely based on membership profits and none based on trading profits.
