The Many Hats of Representation

  1. This thread will attempt to reconcile the duties and obligations of politicians, the media, businesses, voters, and consumers have depending upon the legal relationship they have with each other.

    I am not an attorney, so do not consider anything written here as legal advice.

    Many disputes, civil misconduct, and criminality has been caused by both the improper disclosure of representation and failure of fulfilling the obligations of representation.

    Relationships can be defined by what legal obligations the parties involved owe to each other. The body of law that addresses these relationships is called Law of Agency.

    There are several relationships that are defined under Agency Law. They are:

    1. Client or Principal
    2. Customer
    3. Dual Agent (Illegal in some states because of inherent conflicts of duties owed to each client or customer).
    4. Transaction Agent
    5. Fiduciary - Professional owing the other party representation and or service for compensation.

    Each of the relationships listed is declining order of duties owed. The fiduciary is also owed certain duties, to be discussed later.

    Gov't. people took an oath to defend the constitution and bill of rights, not to put their pensions first.
    How will they lie to me this time, media or CEOs.
    Total transparency is forced on the individual.
    The elite are shielded by non disclosure or it's classified.
    NY judge declared a billion dollar estate is only worth $20 million, declared as a summary judgement without a trail.
