section 1256 contracts question

Discussion in 'Taxes and Accounting' started by fusiforme, Apr 7, 2024.

  1. On my TD Ameritrade 1256 contracts section there are three lines that have numbers:
8 - profit or loss realized on closed contracts in 2023
10 - unrealized profit or loss on open contracts
11 - aggregate profit or loss on contracts

Though I did have some unrealized profit at the time this form was generated, I'm guessing it's the number in 8, my realized profit, that I should be entering - but just wanted to make sure this is correct. Could anyone confirm?

No, it doesn't matter whether a position is open or closed. Even if you have an open position, it should be considered as closed on the last day of the trading day.

U.S. Code ยง 1256 - Section 1256 contracts marked to market
"Each section 1256 contract held by the taxpayer at the close of the taxable year shall be treated as sold for its fair market value on the last business day of such taxable year (and any gain or loss shall be taken into account for the taxable year)"
