The black man did commit a crime. He terrorized the chinese person by spitting on them and then making racial slurs.
Personally i dont think racial slurs are a crime but spitting? What if the black thug had some sort of transmissible disease? Thats a crime.
The chinese person is lucky they werent shot or robbed.
