Agreed, doing it in this fashion has the appearance of Anti-Trump (even though Pelosi is standing there saying the opposite) but they can use it regardless of the election’s outcome, either Trump or Biden.

Someone correct me, but if the President is incapacitated, doesn’t the power automatically go to the VP. When Reagan was shot by Hinckley, didn’t power automatically go to Bush while he was in surgery and recovering?

 

Yes... the power would go to Pence if Trump is medically incapacitated.

 

Rest assured, they can't do it and even if they could, The President would have to sign the bill which he would not do and they would not have the votes to override his veto.
