I'd let it go. For the most part it is what I call "assisted natural selection," I know one smoker that I loved deeply. The rest were overly aggressive spoiled selfish retards. That's not murder, its volunteering.
That's one argument, however, can you show psychological manipulation? Abuse of authority with intent.

You hit on a key point. "Authority" They have none. Its not like they were the customer's parents or police or something. If morons go around hitting themselves in the head with hammers are we going to put the hammer manufacturers in prison? If someone is so dumb they need a sign to figure out that inhaling burning tar might be bad for you, they need to be living in a group home and they should be filing for disability instead of suing the tobacco company.
It's worth noting that gone are the juries of Baby Boomers brought up to believe cigarettes were healthy and cool in technicolor, and here are the juries of Gen-Xers (who are malicious enough not to care), and millennials (who take anti-smoking campaigns for granted are live and let live when people have good info). Consider the likely venues for this (liberal. big. cities.), and that shift is even more pronounced. Send me a buy opportunity!!!

Nicotine - that drug that kills at a rate hundreds of times higher than all the street drugs combined. Ask any Heroin addict & smoker what they fear the most when getting locked up - they will all tell you it's the Nicotine they dread kicking. Cigarette companies were caught adding in other addictive chemicals to keep people hooked - something even the Mexican drug Cartels do not do. This idea that the victims of the Cigarette companies deserve to die is severely flawed. Many of us older people grew up in smoking homes, cigarette commercials played non-stop, movies glamorized smoking, in fact they just about centered on smoking - making is look sexy. Only recently has that started to diminish in films. Kids tried smoking and many got hooked.
