Corporate DEI programs at risk from affirmative action decision

    Left's favorite 'woke' initiative under serious threat after Court's controversial ruling

    he Supreme Court decision last month ruling against affirmative action in higher education could dismantle diversity, equity and inclusion (DEI) programs in corporate America, experts say.

    On Thursday, the Supreme Court in a 6-3 decision said that colleges and universities could not include race considerations in their admissions process, effectively outlawing what's known as affirmative action and upending previous legal precedent that allowed it.

    The decision has sparked debate on if and how it could influence other sectors of public life, including the hiring and promotion practices of companies and corporations.

    Fox News Digital spoke with experts who say the decision could mean that corporations could be held liable for "woke-ism" in DEI programs and policies.

    Will Hild, executive director of Consumers' Research, says that case could expose companies who prioritize race in staffing decisions as violating the Civil Rights Act.

    "That fig leaf has now gone. There's no question that affirmative action, racially based hiring and promotion schemes violate the Civil Rights Act," Hild said.

    "And you no longer have this even potential loophole of the affirmative action jurisprudence. I think one you're going to see a lot of companies, their legal compliance officers, are going to review what their DEI departments are doing and probably tell them to cut it out," he said.

    "I think you'll see a lot of companies who might even get rid of their DEI departments because the philosophy around the DEI is almost directly in contradiction with law to begin with," he added.

    In Europe and Canada...I have heard of DEI software and DEI initiatives to ensure their businesses & technology are a step ahead of the competition in other countries.

    It's very interesting that these countries decided to first address diversity, equity, and inclusion by first targeting gender before focusing on other aspects such as minorities.

    I remember reading that in France as an example...women on boards of companies increased 40%. In Canada, men are given paid paternity leave for a birth/adoption of a child.
    • Parental benefits are paid for a maximum of 35 shared weeks plus 5 weeks of “daddy days”; paid within a year of the birth or adoption of the child...children's health has increased too with men bonding with children along with mother's that are on maternity leave.
    My point, the United States will quickly get left behind in so many critical areas of business and quality of life. Ooops...its already happening considering the United States no longer ranks in the top countries for quality of life, raising a family, raising children, business opportunities et cetera.

    Sweden #1, Denmark #2, Canada #3, Switzerland #4, Norway #5, Finland #6, Germany #7, Norway #8, Australia #9, New Zealand #10 are the top countries now...the United States has fallen down to a rank of 21st.

    In fact, I do have a good memory of certain specific ET members advocating Sweden's policy to not shut down during the Pandemic. One of the reasons for Sweden's decision to not shut-down is their excellent DEI initiatives.
    • We actively promote a culture in which all recognize a responsibility to speak out and act against any form of individual prejudice or systemic discrimination.
    Of course those ET members did not mention the above as one of the key reasons behind Sweden's decision and quick rebound in the Pandemic. :D

    Now back to the United States, the jaw-dropping decline to a rank of 21st is primarily because Europe and Canada are much better at applying their DEI initiatives. The jaw-dropping decline showed its face in the United States during critical supply & demand issues and still is in today's workplace...

    We just do not have the workers, especially skilled workers. In fact, we're already short 1.9 million skilled workers because our DEI initiatives are poor in comparison to other countries.

    In my opinion, it's simple. Demographics have shifted in the world and the U.S. is starting to trend the wrong way far beyond DEI issues.
