I say how about we dont. Let's keep that off the table and let the shorts have a continued fair share at it. The uptick rule was created in 1938 by the Securities and Exchange Commission to prevent short sellers from putting even more pressure on a company that was already struggling, but it was eliminated in 2007 when electronic trading started to become the norm on Wall Street. Cooperman thinks short sellers have only made the market volatility worse, and reinstating the uptick rule would cut down on some of the violent market swings.
It is not surprising Cooperman's call for resumption of the uptick rule. His friends on Wall Street, market makers etc. who were exempt from the uptick rule, always hated the idea that eliminating the uptick rule created a more level field for the retail trader.
This is some neato conspiracy. The uptick rule is designed to prevent a short seller pile up and a drive to zero on fear. You are aware that market prices are, in theory, supposed to represent the value of something right? How is 0.00 the proper value for something when it's driven there by panic and greedy shorts? I love shorting as much as the next guy but you have to be smoking some really good stuff to believe what you believe. Do you also believe that limit up and down in the futures markets is some conspiracy to blow out retail accounts? Markets are not supposed to be horse races for degenerates. Without rules like futures limits and upticks is may as well just be a game for degenerates. To your point the uptick rule should apply to everyone - insiders included (though im not sure how you can enforce it on a market maker).
Got some really bad news for you. Stock market degenerates are at LEAST as bad as horse bettors , and there are a lot more of them
is it that obvious...….why should buyers be allowed to buy on up ticks? if shorts are only allowed to sell on up ticks?
There's no uptick rule on futures so if size players offer heavy into the basis then the cash bid gets hit cuz the market maker will lay risk off in the underlying. Doesn't seem fair that BD's and prop can short the whole index for size but retail can't offer into a cash bid on the way down. Trading stocks is a tough game.
