ACB recuses from Penn. election case

  3. Regardless of whether she recuses or not, I am not sure I see what justifies a happy dance by the forum idiots. The ruling is just on the motion to have the Supreme Court review it on an accelerated basis rather than up through appeal or normal time. Dems are acting like they have rendered a final ruling on the issue, when the court has clearly said that there is time for the court to review it after the election as needed so they do not see the downside to letting the appeals court review it.

    Might be a matter of when the dems want to take their pain. If the Court ultimately disqualifies those ballots after the election, the demmerhoids may end out wishing that the court had shot it down earlier so that they could have sounded the alarm and told people to go out and vote in person at the polls.

    She probably will recuse even after the local petitioners drop their request because that is something she can just decide to do without a petitioner and she does not want to slow down the process by having to come up to speed. However, don't expect her to recuse if the full Court takes up the case after the election.

    The other thing of course is that the Court always avoids taking up cases that might be moot by the time it reaches the Court. If Biden - for example- gets enough votes in PA such that the qualification or disqualification of late arrival ballots would not change the outcome of case, the Court may not want to even review it. Of course there other candidates on the ballot too so they might have an interest in going forward on it. And some of the candidates might be for state offices and the supreme court may defer to the state supreme court on that. It gets complicated. Or could anyway.
