Second Amendment "...A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms shall not be infringed..." Are not the proposed gun regulations "infringements"?
Yes. If they somehow ram this legislation through, it will end up in SCOTUS and be tossed out as unconstitutional like all those before it.
Second Amendment "...A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms shall not be infringed..."
Already been brought before the court on several occasions, already been decided..... the right of the people to keep and bear Arms shall not be infringed...
Its plan to anyone who can read what it means. It is even plainer for anyone who understands the mindset of those times. I don't accept the Wayne LaPierre version. You go back to looking like a bully against women today, you are just an echo for some propogandist. The rest of us will use our minds to make decisions.
So, the well-regulated militia shall be regulated? How is that infringement? You know the legal morass the 2A has been mired in for 200+ years. Nothing new.
"Regulated" is a subjective concept. "Shall not be infringed" seems not subjective. In a sense, however the two notions seem to be at odds. Then again, "regulated militia" may not be the same as "infringed right to bear arms." The spirit of 2A, IMV, is to allow citizens the ability to defend themselves from overreaching, tyrannical government (including ours)... which is the issue today.
%% And so far , the great state of TX is winning on the border ''infringement'' court case. I dont own any pistol magazines that hold over 10 rounds, but even CA courts declared that CA law /10 round limit an unlawful infringment.....................................................................................................Another big problem for some/ all 50 states have a fish + game department that depends on the 10%user fee/excise tax on guns + ammo for their budget.
