No. You (a Bahamas citizen) and UBS Bahamas (your broker, in Bahamas) entered into a contract (in Bahamas), and you are alleging that UBS Bahamas has violated the contract in processing your trades (made in Bahamas). It has nothing to do with US laws. Your civil district court has sole subject matter jurisdiction.

You would be better off spending your time at your local library reading up on district court civil procedures, rules of evidence and principles of contract law etc. Again, your case has got nothing to do with the US. Btw, if UBS never sent any trades, how could NYSE process them? And no, it doesn't matter if UBS did send them. Stop wasting time here. Go to your local library and ask the librarian for help in locating books on legal proceedings and contract law.
Brrr. I am not wasting time here and my husband is in libraries for the last two years everyday, this is how our pleedins made, we have obtained Leave to Appeal and now heading towards case management conferance in the cross-action. I am taking a precious seep of energy from ET, which is giving me more strength, to stay connected with other traders and have their precious support. As for the orders - they must have exact references, as by USA law. The same thing Mr. Madoff did, it calls now fictitious trading and it is criminal offence. So, once both banks has failled to provide us with it, so far, for our view the option is to meditate on next Madoff's case n.2 in USA brought from the Bahamas. Should we lost in the court here, this would be the option.

Still, we have before judge three application: - Summons for struck our their defense where it is not properly traversed and limited to material denials or not admitting, {which is against Rules of the Supreme Court,} and out of 580 points of our claim (the remanent 75 of our claim are general points), UBS' defence is 480 points with non traversal or non admitting, without any facts, piece of evidence, nothing. - Summons for a Summary Judgment for this points of the Defence - Summons for an Order for production of the Documents - so far we issue five notices, for the brokers note (known in USA as time and price , for the money transaction, for access to Sma, for which other clients they had on this "product", if they, for license they had at the date they signed the contract with us (for loan, mortgage, and SEC registration).
