    To clarify further for the borderline functional dimwits...

    If you're going to payout on something non exchange-traded then it needs to be a "legitimate" OTC market like FX (in the US) operating as a regulated/icensed OTC operation. You can even offer "index fungible" products like IG's "US500" to clients, but not in the US. These are effectively index-linked CFDs.

    This idiot at APEX is not offering any of the aforementioned. Anything other than a pooled BD-account and orders hitting the tape is illegal. In fact, pooling outside of a K-1 arrangement is illegal. Individual participants would need their licenses as well.

    APEX offering payouts on sim-trading is over the top. Legality is not open to debate. Whether the OP is paid on a sim or production? Just dig a hole.

    So not paying out based upon some retroactive, fuzzy rules is a scam, illegal and in no way defensible but at its core the operation is illegal.

    You're on sim for the challenge and once you pass the combine you are hereby "FUNDED". It doesn't mean anything but yes indeed you're funded.

    So you trade sim and there is zero conflict of interest as I see you fail, miserably.

    This is how every firm in this space operates initially. For example, with Topstep (which is 100 % legitimate as far as I can tell and have experienced) - you're moved to a so called Express Funded Account if you pass their program where you trade in a simulator.

    In the past, they would move you to an actual live account at their discretion, but with the current rules I believe they move you to a live account after 5 x 5K withdrawals from the XFA account. Or sooner at their own discretion.

    When it's time to file your taxes - you're paid as an independent contractor for Topstep. Like an employee providing a service to the firm. And I believe that's the same whether you're trading their SIM accounts or a production account as you call it.
