The ex-president is facing two such orders related to his social media attacks on people involved in his various court cases. Last week, he was fined $10,000 for a second violation of the gag order in the New York civil case, which prohibits him from disparaging members of the court staff. But Cobb said the other one is more “consequential.” U.S. District Judge Tanya Chutkan, overseeing his Washington, D.C., election interference case, on Sunday, reinstated her order prohibiting Trump from disparaging prosecutors, court staff or potential witnesses. Trump, he said, keeps doing that ― and predicted the judge won’t tolerate it or let him off easy. “I think she’ll come in with a much heavier penalty,” Cobb told CNN’s Erin Burnett. “And ultimately, I think he’ll spend a night or a weekend in jail. Federal District Court Judge Tanya Chutkan reinstated her gag order on Trump Sunday after some legal wrangling that included a temporary stay at Trump’s request so the judge could consider whether to lift the order pending appeal. In her blistering decision reinstating the gag order, the judge knocked down the defense’s arguments one by one, including Trump’s frequent and false claims that it infringed on his First Amendment rights. But in a filing to the Court of Appeals for the D.C. Circuit Thursday, Trump attorneys elaborated on many of the same arguments that Chutkan smacked down, and made some flowery claims about their client’s “voice”: The district court entered a sweeping, viewpoint-based prior restraint on the core political speech of a major Presidential candidate, based solely on an unconstitutional “heckler’s veto.” The Gag Order violates the First Amendment rights of President Trump and over 100 million Americans who listen to him. President Trump’s uniquely powerful voice has been a fixture of American political discourse for eight years, and central to the American fabric for decades. The prosecution’s claim that his core political speech suddenly poses a threat to the administration of justice is baseless. The prosecutors and potential witnesses addressed by President Trump’s speech are high-level government officials and public figures, many of whom routinely attack President Trump in their own public statements, media interviews, and books. President Trump’s viewpoint and modes of expression resonate powerfully with tens of millions of Americans. The prosecution’s request for a Gag Order bristles with hostility to President Trump’s viewpoint and his relentless criticism of the government—including of the prosecution itself. The Gag Order embodies this unconstitutional hostility to President Trump’s viewpoint. It should be immediately stayed. In her decision reinstating the gag order, Judge Chutkan addressed the First Amendment claim by writing “Defendant’s repeated appeals to broad First Amendment values therefore ignore that the court—pursuant to its obligation to protect the integrity of these proceedings—recognized those values but, in balancing them against the potential prejudice resulting from certain kinds of statements, found them outweighed.” The judge’s order was, however, silent on the issue of the “American fabric.”
