MBTrading not classifying as Professional Trader and back-charging fee's

  1. I am registered with MBTrading as a corp. entity but were not as a professional trader. MBTrading is now trying to change the classification as professional trader. By doing so they are back-charging monthly data fees for each exchange for as long as you had an account. All this is being done without any prior notification. I know that I cannot be the only one. So I want to find as many of us out there as possible to investigate the possibility of a class action lawsuit or any other legal action against them.

    Where are you getting this information? I copy/pasted part of a notice from MB Trading. Today is the deadline to sign. I see nothing about back-charging data fees for for each exchange for as long as you had an account. What if you had an account for let's say 10 years? Please copy/paste writings you have from MB Trading that make you want to take legal action.

    Dear Valued Customer,

    The CME exchange has amended their data fee agreement forms to designate professional versus non-professional subscribers. As such, MB Trading is required to obtain amended agreements to replace pre-existing agreements in order to maintain your non-professional subscription. Please download and sign the Exhibit A to Schedule 4 form by no later than Thursday, February 19, 2015 by faxing these documents to New Accounts at (310) 388-3115 or you may also submit the completed paperwork via the secure client ticket system. If we do not receive this form by Thursday, February 19, 2015 your futures data quote subscriptions will be disabled and your account will be charged for professional subscription, in which you will be subject to professional

    If you are a corp entity, then you ARE a professional trader. You are not a non-pro if trading thru an entity.

    That's not necessarily true.
    "Non-Professional shall mean and include either (i) an individual, natural person Subscriber(s) who, or (ii) certain small business entities (limited liability companies, partnerships, trusts or corporations)..."
